Abstract of her speech:
Since the start of Israeli hostilities in October 2023, with widely documented war crimes and crimes against humanity in the Gaza Strip, the role and effectiveness of the international legal system created after the two world wars to uphold justice and peace has come under increasing criticism. Significant measures, such as those of the International Court of Justice (ICJ) and the International Criminal Court (ICC), as well as by national courts, have begun – albeit belatedly – to demonstrate the potential of international justice to address long-standing atrocities against Palestinians. But the case of Palestine, and Gaza in particular, has strained the multilateral system to the brink of collapse. This is a reminder that the implementation of international law ultimately depends on the political will of states. If this will is lacking and impunity prevails, the very foundation of the international legal system is undermined – and with it the rights of every individual. In the face of this grim reality, however, the case of Palestine and the global efforts of Palestinians and their allies also show how international law provides a framework within which a significant part of civil society has been mobilized to fight structural injustice. Local collectives, student organizations, trade unions, academics and concerned individuals from diverse socio-economic backgrounds use a variety of strategies to hold those in positions of power accountable. In this context, international law is emerging as a crucial tool to amplify marginalized voices and challenge systems of oppression. Nevertheless, much remains to be done for international law to fully realize its emancipatory goal.
About the person:
Ms. Francesca Albanese was appointed Special Rapporteur on the situation of human rights in the Palestinian territories occupied since 1967 by the Human Rights Council at its 49th session in March 2022 and took up her post on 1 May 2022. Ms. Albanese is an Affiliate Scholar at the Institute for the Study of International Migration at Georgetown University and Senior Advisor on Migration and Forced Displacement at the think tank Arab Renaissance for Democracy and Development (ARDD). She has published widely on the legal situation in Israel and the State of Palestine and regularly teaches and lectures on international law and forced displacement at universities in Europe and the Arab world. Ms. Albanese has also worked as a human rights expert for the United Nations, including for the Office of the UN High Commissioner for Human Rights and the UN Relief and Works Agency for Palestine Refugees.
